Mr G and his wife parted. There was one child of the relationship. The wife had not had a particularly good relationship with the daughter and the wife had been involved in activities which made her care of the child somewhat suspect.
After parting the child remained in Mr G's care. The wife applied to obtain access. Our client took advice from us and based on his instructions we took the view that the child was better in his care. This was helped by the fact that the child herself was indicating that she wished to remain in her father's care. As a result of the Family Court proceedings a psychologist's report was ordered and Counsel for the Child was appointed.
The result of enquiries substantiated our client's stand about the matter including support for his view that the child was taking a reasonable approach herself in wishing to be with her father. Arrangements were made for the mother to have supervised access through Barnadoes because of the dysfunctional relationship between the child and her. Custody remained with our client. |
