Mr & Mrs F were aged in their 60s. Both had been married before. Both had children of previous relationships. However as sometimes happens, when they purchased their current home the question had not been asked as to whether they wished to have their property owned jointly or in some other way. Without our clients knowing it this left them in a situation where they had only limited ability to control their assets when it came to preparing Wills and making estate planning decisions.
Our advice was to change the ownership from joint ownership to ownership in equal shares. This then enabled both husband and wife separately to make new Wills to provide for each other (life interest provisions etc.) as well as enabling each to provide appropriately for their children of the former marriage/relationship. |
